Terms of Use

This translation is provided for reference only. In the event of any discrepancy, the Japanese version shall prevail.

These Terms set out the conditions for using tiệm note (the “Site”), operated by MAKERS YARD COMPANY LIMITED (the “Company”). The Site is free to use.

Article 1 (Listing information)

1. Listing information is accurate as of the check date shown on each shop page. Opening hours, prices, products and other details may change, so please also check the shop’s official information before you go.
2. Purchases, payments and returns of products are transactions between you and each shop. The Company is not a party to those transactions.
3. Information for travelers (such as restrictions on taking items out of or into a country) is general guidance only. For individual cases, please check with the shop or the relevant authorities.
4. Shop locations on the map include estimates based on street addresses. Estimated locations are marked as such.

Article 2 (Types and labeling of photos)

Photos on the Site are labeled with their source.

So that a shop’s image is not shaped solely by photos from the shop, covers and listings also combine photos taken by our editors and those submitted by visitors.

Article 3 (Submissions)

1. Anyone who sends photos or text (“Submissions”) via the report form or by email agrees to the following.
   1. It was taken or created by you
   2. People’s faces and vehicle license plates are not clearly visible (photos in which they are visible will not be published)
   3. It was not taken in a place where the shop prohibits photography
   4. Do not include information that can identify individuals, such as names or contact details
2. Copyright in Submissions remains with the contributor. The contributor grants the Company permission to use and edit Submissions (cropping, adjusting brightness, removing location data, etc.) free of charge on the Site and in its promotion (including social media and translated versions). The contributor agrees not to exercise moral rights against the Company or any party licensed by it.
3. Submissions are never published on the Site as they are. Our editorial team reviews the content, checks it against the shop’s official information and other sources, and then reflects it in the listing information as editorial information. The Company also decides whether to publish submitted photos and which photo to use as the cover. Published photos are labeled “Visitor submission”.
4. Because the report form accepts submissions anonymously, the Company cannot reply to contributors or notify them of the outcome.
5. Contributors may request deletion at any time, even after publication. As report form submissions are anonymous, please tell us the date you sent it, the shop and the content (for photos, the page on which it is published) when making a request.
6. We do not accept the following Submissions and will delete them even after publication: those that infringe the rights of others, false information, promotion that conceals its advertising nature, and anything that violates Vietnamese or Japanese law.

Article 4 (Prohibited conduct)

The following are prohibited: automatically collecting large amounts of information from the Site and republishing it on other services; making automated submissions or repeatedly sending identical content through the report form; interfering with the Site’s operation; and causing a nuisance to other users or shops.

Article 5 (Copyright)

Copyright in the Site’s text, photos taken by our editorial team and design belongs to the Company or the rightful holders. You are welcome to print pages to plan your own trip and to link to pages. Map data is © OpenStreetMap contributors (ODbL).

Article 6 (Disclaimer)

1. The Company strives to keep listing information accurate, but is not liable for errors in information resulting from circumstances the Company could not have known of, such as changes in a shop’s operating status.
2. The preceding paragraph does not apply to damage caused by the Company’s willful misconduct or gross negligence. In addition, where the user is a consumer, it does not limit any liability that cannot be limited under the laws of the user’s place of residence.

Article 7 (Amendments to the Terms)

When the Company amends these Terms, it will announce the changes and their effective date on the Site in advance.

Article 8 (Governing law and jurisdiction)

These Terms are governed by Vietnamese law. However, where the user is a consumer, this does not preclude the application of consumer protection provisions under the laws of the user’s place of residence. Any dispute shall first be addressed through good-faith discussion.
